Montgomery County Precinct 3 detectives arrested a Spring man at a hotel in The Woodlands on Monday, on a felony family violence charge three days after the alleged assault sent a victim to the hospital.

Alfonso J. Aguilar, 37, faces a charge of assault of a family member by impeding breath or circulation, a third-degree felony punishable by two to 10 years in prison and up to a $10,000 fine under Texas Penal Code.

Deputies with Constable Ryan Gable's office responded to the reported assault at a Spring residence on Friday, Aug. 7, according to a Precinct 3 press release published by Woodlands Online. Investigators determined Aguilar allegedly applied pressure to the victim's neck, impeding the victim's breathing, then fled the scene.

The victim was examined at a hospital, where medical personnel documented injuries consistent with the reported assault.

Detectives reviewed the case, established probable cause and obtained an arrest warrant. They located Aguilar at a Woodlands-area hotel on Aug. 10 and took him into custody without incident.

He did not resist.

Gable's office, headquartered at 1520 Lake Front Circle in The Woodlands, called strangulation a serious and potentially deadly offense in the release. Under Texas law, the charge applies even when no serious bodily injury occurs; prosecutors need only show the defendant intentionally, knowingly or recklessly impeded normal breathing or circulation by applying pressure to the throat or neck.

No bond information or court date has been released. Aguilar is booked in the Montgomery County Jail and is presumed innocent unless proven guilty in a court of law.
